Terms & Conditions – Live Bright

Participant’s Responsibility and Liability: Participant is solely responsible for creating and implementing his/her own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the programming provided by Molly Moran / LIVE BRIGHT. As such, the participant agrees that Molly Moran / LIVE BRIGHT is not and will not be liable or responsible for any actions or inaction or for any direct or indirect result of any services provided by Molly Moran / LIVE BRIGHT. Participant understands that any of the free or paid programming provided by Molly Moran / LIVE BRIGHT is solely at the participant’s risk. Molly Moran / LIVE BRIGHT encourages Participant to seek medical advice prior to participation in any of physical activity recommended by program.

Intellectual Property: Molly Moran / LIVE BRIGHT retains all right, title and interest in any and all intellectual property related to or associated with the Services and programming, including without limitations: (a) patent rights (including patents and patent applications, whether registered or unregistered), trade secrets, trademarks, and trademark applications (whether registered or unregistered), copyrights and copyrights applications (whether registered or unregistered), mask works, and any other confidential information pertaining to such intellectual property rights; (b) any right to use or exploit any of the foregoing, and (c) any other proprietary right arising under that laws of the United States. Participant understands and agrees that Molly Moran / LIVE BRIGHT is not transfering, assigning or licensing any intellectual property to participant. Participant acknowledges that the content of the Services, including without limitation the materials and information provided to Participant as education, is confidential and proprietary to LIVE BRIGHT; accordingly, Participant agrees that they shall not communicate the teachings, materials, or information acquired or learned from LIVE BRIGHT to another person. Participant acknowledges that communicating the content of any Services to another person would work substantial and irreparable injury to LIVE BRIGHT, notwithstanding any other provision of these Terms And Conditions, LIVE BRIGHT is entitled to obtain a temporary, preliminary or permanent injunction from any court of competent jurisdiction, as necessary to prevent any injury.

Guarantees. Molly Moran / LIVE BRIGHT makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the programming/ services provided. In no event shall Molly Moran / LIVE BRIGHT be liable to the Participant for any indirect, consequential or special damages. Molly Moran / LIVE BRIGHT is not a medical professional and holds no liability for physical, emotional, or mental health of Participant. Notwithstanding any damages that the Participant may incur, Molly Moran / LIVE BRIGHT’s entire liability under these Terms & Conditions, and the Participant’s exclusive remedy shall be limited to the amount actually paid by the Participant to Molly Moran / LIVE BRIGHT.

These Terms & Conditions shall be governed and construed in accordance with the laws of the State of New Mexico, United States, without giving effect to any conflicts of laws or provisions.
